Welcome to Charger Exchange. These Terms and Conditions (hereinafter, “Terms”) govern your use of our multiplatform application (Web, iOS, Android) and our EV charger rental services. By accessing or using our services, you agree to comply with these Terms. If you do not agree with any part of these Terms, please do not use our services.
1. Acceptance of the Terms
By using our App and services, you agree to and agree to abide by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, you should not use our App.
2. Definitions
- “Application” refers to the Charger Exchange platform, available in Web, iOS, and Android versions.
- “User” means any person who accesses and uses the Application.
- “Owner” refers to users who register and rent their chargers on the platform.
- “Renter” refers to users who reserve and use chargers through the Platform.
- “Charger” refers to the electric vehicle charging devices registered on the platform.
3. Registration and User Account
3.1 Registration
To use certain services, you must register and create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3.2 Eligibility
You must be at least 18 years old to register and use our services. By registering, you represent that you are of legal age to enter into a binding contract.
3.3 Accuracy of Information
You agree to provide truthful, accurate, current, and complete information during the registration process and to update such information as necessary.
4. Use of the Application and Services
4.1 License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our application and services in accordance with these Terms.
4.2 Permitted Use
You agree to use the Application only for purposes permitted by these Terms and any applicable laws, regulations, or generally accepted practices in applicable jurisdictions.
4.3 Restrictions
The following are prohibited:
- Use the application for any illegal or unauthorized purpose.
- Use, copy, modify or distribute any content of the application without our prior written consent.
- Interfere or attempt to interfere with the proper working of the application.
5. Payments, Collections and Withdrawals through Stripe
5.1 Use of Stripe
To process payments, collections, and withdrawals on the Charger Exchange platform, we use Stripe as our payment service provider. Stripe is a secure and reliable payment solution that allows for efficient transaction processing.
5.2 Creating a Stripe Account
To rent your charger to other users and receive payments, you need to create a Stripe account. This process is completely free and can be done from the app itself by going to your profile wallet and linking your account. There are no maintenance or subscription fees for the Stripe account; it’s completely free.

5.3 Stripe Fees
Stripe charges a small percentage of each transaction made on the platform. You can find Stripe’s exact fees at this link.
5.4 Generating Revenue in the App
Once you’ve created your Stripe account, you’ll be able to generate revenue through the Charger Exchange platform. These funds will be stored in your in-app wallet, and you’ll be able to:
- Save funds for future bookings: Use your balance to make payments at other chargers registered by other users.
- Withdraw funds: You can transfer the funds generated directly to your bank account at any time using Stripe Connect.
5.5 Charger Exchange Fee
Charger Exchange retains 5% of the profit from each transaction made through the platform. This is the only fee we charge; use of the app is completely free for all users.
5.6 Payment Confirmation Policy
Once a charger reservation has been made, the user has 15 minutes to complete the payment. If payment is not confirmed within this timeframe, the reservation will be automatically canceled, freeing up the time slot for other users.
5.7 Payment Methods
Payments can be made by bank card without a Stripe account. However, if you wish to rent your charger to other users and receive payments, you will need to have an active Stripe account.
5.8 Shipper Registration
Owners can register their shippers by providing accurate and complete details, including location, shipper type, fees, and photos.
5.9 Charger Reservations
Renters can search for and reserve available chargers based on location and other criteria. Reservations are subject to availability and rates specified by the Owner.
5.10 Payments
All payments and transactions are processed through Stripe. By using our services, you agree to Stripe’s terms and conditions.
6. Responsibilities and Disclaimers
6.1 Owner Responsibilities
Each Owner is responsible for providing truthful and accurate information about the charger they make available on the Platform. This includes, but is not limited to, the location, charger type, rates, and operational status of the charger.
6.2 Renter Responsibilities
Renters are responsible for using the chargers safely and respectfully, following the instructions provided by the Owner. Any damage caused to the charger will be the Renter’s responsibility.
6.3 Charger Exchange Disclaimer
Charger Exchange is not responsible for:
- The status and operation of the chargers registered on the platform.
- The veracity of the information provided by users.
- The effective execution of reservations and transactions between users.
- The maintenance of the chargers or compliance with the rules of use.
The platform is merely an intermediary that allows users to list their carriers and make reservations. All transactions and use of the carriers are under the sole responsibility of the users involved.
6.4 Conditions and Protocols of Use Each user (Owner) must establish and communicate their own conditions, rules, and protocols of use for the proper functioning of their charger. It is the Owner’s sole responsibility to ensure that these rules are clear and followed by Renters.
7. User Responsibilities
7.1 User Conduct
You agree to use the application responsibly and not engage in any activity that could harm other users or the platform.
7.2 Ownership of the Shipper
Owners warrant that they have all necessary rights to register and rent their shippers on the platform and that they comply with all applicable laws and regulations.
7.3 Use of the Charger
Tenants agree to use the chargers safely and responsibly, following all instructions provided by the Owner and applicable regulations.
8. Limitation of Liability
8.1 Disclaimer of Warranties
The Application and Services are provided “as is” and “as available.” We do not guarantee that the Application will be error-free, secure, or uninterrupted.
8.2 Limitation of Damages
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any lost profits or data, arising from the use of or inability to use the Application or Services.
9. Intellectual Property
9.1 Proprietary Rights
All rights, title, and interest in and to the Application and Services, including all intellectual property rights, are and shall remain the exclusive property of Charger Exchange and its licensors.
9.2 Use of Content
You may not use, copy, modify, distribute, sell, or rent any part of the Application or Services without our express written permission.
10. Changes to the Terms and Services
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms in this document and via a link from our app. Your continued use of the app after such changes constitutes your acceptance of the new Terms.
11. Dispute Resolution
11.1 Applicable Law
These Terms shall be governed by and construed in accordance with the laws of Spain.
11.2 Arbitration
Any dispute arising out of or in connection with these Terms or the use of the Application shall be resolved by binding arbitration in accordance with the rules of the Spanish Court of Arbitration, and the arbitrator’s decision shall be final and binding.
